Padelatos Terms of Service

Welcome to Padelatos. By accessing or using our platform (website, web application, and progressive web app), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Padelatos. Please read them carefully, as they define your rights, obligations, and the conditions under which you may use our services.

1. Definitions

  • "Platform" refers to the Padelatos website, web application, and progressive web app (PWA), including all features and services accessible through them.
  • "Club" refers to a padel club brand registered on the Platform that manages one or more Locations.
  • "Location" refers to a physical venue operated by a Club, containing one or more courts.
  • "Player" refers to any individual who creates a player profile on the Platform to find games, join tournaments, or participate in training sessions.
  • "Staff" refers to individuals appointed by a Club to manage a Location, including Owners, Admins, and Staff members.
  • "Booking" refers to any court reservation made through the Platform, whether for games, training sessions, or blocked time.
  • "Community Game" refers to a game created by a Player outside of a Club's infrastructure, at any venue.
  • "Rating" refers to the algorithmic skill assessment assigned to Players based on their match results.

2. Account & Access

  • Eligibility: You must be at least 16 years old to create an account and use the Platform. If you are under 18, you confirm that you have parental or guardian consent.
  • Account Creation: You may register using email with one-time password (OTP), email with password, or Google OAuth. Each individual may maintain only one active account.
  • Account Security: You are solely responsible for maintaining the confidentiality of your login credentials. All activity that occurs under your account is your responsibility. You must notify us immediately at hello@padelatos.com if you suspect unauthorized access.
  • Accuracy of Information: You agree to provide accurate, current, and complete information during registration and to keep it updated. This includes your name, contact details, and any club-related information.
  • Account Types: The Platform supports two primary account types: Player accounts (for finding and joining games) and Club accounts (for managing venues and organizing events). Club creation is subject to approval.

3. Service Description

Padelatos is a platform that connects padel clubs with players. We provide the following services:

For Clubs:
  • Court booking management with visual scheduling
  • Recurring (permanent) booking management
  • Tournament creation and management (Americano, Mexicano, Group Stages, Brackets)
  • Training session scheduling with coach assignment
  • Member and staff management with role-based access control
  • Player replacement request system for last-minute cancellations
  • Bookable slot publishing for player-initiated reservations

For Players:
  • Game discovery and participation across clubs and cities
  • Community game creation at any venue
  • Tournament registration and live participation
  • Training session enrollment
  • Algorithmic skill rating and tier progression
  • Club membership and access to members-only events
  • Multi-channel notifications (in-app, email, push)

Important: Padelatos operates solely as a technology platform. We do not own, manage, or operate any padel courts or venues. The quality of facilities, safety conditions, and conduct of games are the exclusive responsibility of each Club or venue operator.

4. User Roles & Responsibilities

Club Owners are responsible for:
  • The accuracy of their club and location information (address, operating hours, court details)
  • Managing their staff, including assigning appropriate permission levels (Owner, Admin, Staff)
  • Ensuring their cancellation and refund policies are clearly communicated to players
  • Compliance with local regulations regarding sports facility operation

Staff Members are responsible for:
  • Acting within the scope of permissions granted by their Club
  • Accurately managing bookings, game sessions, and tournament results
  • Handling member and player data in accordance with privacy regulations

Players are responsible for:
  • Honoring confirmed bookings and showing up on time
  • Following each Club's specific rules and cancellation policies
  • Reporting accurate game results when participating in result voting
  • Maintaining sportsmanlike conduct during games and on the platform

5. Bookings & Court Reservations

  • Booking Confirmation: A booking is considered confirmed once it appears as such in the Platform. Confirmation does not guarantee court availability in case of Club-side technical issues or force majeure.
  • Recurring Bookings: Clubs may create permanent (recurring weekly) bookings. These are automatically generated for upcoming weeks. Cancellation of individual occurrences must follow the Club's cancellation deadline policy.
  • Bookable Slots: Clubs may publish available time slots for player booking. These slots may require approval from the Club before confirmation. Slot availability is subject to change without notice.
  • Cancellation: Players must adhere to each Club's cancellation policy. Padelatos is not responsible for refunds due to no-shows or late cancellations by the player. Cancellation deadlines are set by each Club.
  • Replacement System: When a player cannot attend a confirmed game, the Club may initiate a replacement request. Candidates are notified and the first player to accept fills the spot. Padelatos is not responsible if no replacement is found.
  • No-Show Policy: Repeated no-shows without proper cancellation may result in restrictions on your ability to make future bookings, at the discretion of each Club.

6. Tournaments

  • Registration: Tournament registration may be automatic or require approval. Some tournaments have skill level or rating restrictions for eligibility. Registration does not guarantee a spot if maximum capacity is reached (waitlist applies).
  • Entry Fees: Tournaments may require an entry fee. Entry fees are set by the organizing Club. Refund policies for tournament entry fees are determined by each Club.
  • Formats: The Platform supports multiple tournament formats including Americano, Mexicano, Group Stages, and Bracket (single/double elimination). Rules and scoring vary by format and are configured by the tournament organizer.
  • Results & Scoring: Match results entered on the Platform are considered final once confirmed by tournament administrators. Disputes about match results should be raised with the organizing Club directly.
  • Rating Impact: Participation in ranked tournaments affects your player rating. Tournament results are processed with dampened rating changes compared to regular ranked games. By participating, you accept that your rating will be adjusted algorithmically.
  • Live Pages: Tournament data may be displayed publicly on live pages accessible via shareable codes. By participating, you consent to your name, team, and match results being visible on these pages.

7. Community Games & Rating System

Community Games:
  • Players may create games at any venue, independent of registered Clubs.
  • Community game creation is rate-limited to prevent abuse.
  • The game creator is responsible for the accuracy of venue details and game information.
  • Padelatos assumes no responsibility for the venue, safety, or conduct of community games.

Rating System:
  • The Platform uses an algorithmic rating system (based on OpenSkill/Bayesian methods) to assess player skill levels.
  • Ratings are calculated automatically based on ranked game and tournament results.
  • Your rating, tier (Beginner, Intermediate, Advanced, Master), and match statistics are visible to other users on the Platform.
  • Game results are determined through a consensus-based voting system among participants. A minimum number of votes is required to lock a result.
  • Deliberate manipulation of results, including intentional losing, collusion, or fraudulent voting, is strictly prohibited and may result in account suspension.
  • Padelatos does not guarantee the accuracy of the rating system as a measure of absolute player skill. Ratings are relative and intended for matchmaking purposes.

8. Notifications & Communications

  • Service Notifications: By using the Platform, you agree to receive essential service notifications including booking confirmations, game reminders, cancellation alerts, tournament updates, and replacement requests.
  • Notification Channels: Notifications may be delivered via in-app messages, email, and/or browser push notifications. You may customize your notification preferences per category in your account settings.
  • Push Notifications: Browser push notifications require your explicit permission. You can revoke this permission at any time through your browser settings.
  • Email Communications: We use email for transactional notifications (booking confirmations, invitations, reminders). We do not send unsolicited marketing emails without your consent.
  • Game Reminders: The Platform sends automatic reminders before confirmed games. These are considered essential service communications.

9. Financial Terms & Payments

  • Club Subscriptions: Management plans are billed in advance on a monthly or annual basis. Late payment may result in temporary suspension of access to the management dashboard. Pricing details are available on our website and may be updated with 30 days' notice.
  • Free Trial: New Clubs may be eligible for a free trial period. At the end of the trial, a paid subscription is required to continue using Club management features.
  • Platform Fees: For player-facing transactions (court bookings, tournament entries, training registrations) processed through the Platform, Padelatos may retain a service fee as specified in the Club's partnership plan.
  • Player Services: The Platform is free for Players. No subscription or fees are required to create a player profile, join games, or participate in tournaments (excluding any entry fees set by Clubs).
  • Refunds: Padelatos does not directly handle payment disputes between Clubs and Players. Refund eligibility is determined by each Club's cancellation policy. For subscription-related refunds, contact us at hello@padelatos.com.
  • Price Changes: We reserve the right to modify subscription pricing with at least 30 days' advance notice. Existing subscriptions will be honored until the end of the current billing period.

10. Code of Conduct (Fair Play)

All users agree to the following rules of conduct. Violation may result in warnings, temporary suspension, or permanent account termination:
  • No Harassment: Do not use the Platform to harass, bully, threaten, or intimidate other users, whether through messages, game behavior, or any other means.
  • No Spam or Abuse: Do not send unsolicited messages, create fake bookings, or misuse any Platform feature for purposes other than its intended use.
  • No Fraud: Do not attempt to manipulate game results, ratings, or any scoring system. Do not create multiple accounts to circumvent restrictions.
  • No Unauthorized Access: Do not attempt to bypass, probe, or exploit the Platform's security measures, authentication systems, or payment infrastructure.
  • No Scraping: Do not use automated tools, bots, or scripts to extract data from the Platform without written permission.
  • Respect for Others: Treat all community members with respect, both on the Platform and at physical venues. Discriminatory or offensive behavior based on race, gender, religion, nationality, disability, or any other characteristic is strictly prohibited.
  • Honest Reporting: Report game results truthfully. The integrity of the rating system depends on honest participant voting.

11. Intellectual Property

  • Platform Ownership: The Padelatos software, brand name, logos, code, design, algorithms (including the rating system), and all associated intellectual property are the exclusive property of Padelatos.
  • User License: You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purposes: organizing games, managing clubs, and participating in padel activities.
  • Restrictions: You may not copy, modify, distribute, sell, or create derivative works based on the Platform or any of its components without our express written consent.
  • User Content: Any content you upload to the Platform (profile information, club details, images) remains your property. However, you grant Padelatos a non-exclusive, worldwide, royalty-free license to use, display, and process this content solely for the purpose of providing the service.

12. Data Ownership & Portability

  • Club Data: Data that Clubs enter about their business (location details, court configurations, operating hours) and their customers (member profiles, booking records) belongs to the Club. Clubs grant Padelatos a license to process this data for the provision of the service.
  • Player Data: Players retain ownership of their personal information. Your rating, match history, and statistics are generated by the Platform based on your activity and are part of the Platform's service.
  • Data Export: Upon written request, Clubs may receive an export of their customer and booking data in a standard format, subject to applicable data protection regulations.
  • Data After Termination: Upon account deletion, your personal data will be removed in accordance with our Privacy Policy. Aggregated, anonymized data may be retained for analytical purposes.
  • Third-Party Processing: The Platform uses third-party service providers for hosting, authentication, email delivery, and other essential functions. Your data is processed by these providers solely for the purpose of delivering the service, in compliance with GDPR.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Padelatos shall not be held liable for:
  1. Physical Harm: Any injuries, accidents, or health issues occurring during games, tournaments, training sessions, or at any venue, whether managed by a registered Club or used for community games.
  2. Club Operations: Operational issues of Clubs including but not limited to: double bookings due to offline calendar mismanagement, facility maintenance problems, staff conduct, or failure to honor bookings made through the Platform.
  3. Rating Accuracy: The algorithmic rating system is provided for matchmaking purposes only. We do not guarantee its accuracy as an absolute measure of player skill and accept no liability for decisions made based on ratings.
  4. Third-Party Actions: Actions or omissions of other users, Clubs, or any third parties that interact with you through the Platform.
  5. Service Interruptions: Temporary or extended service disruptions due to maintenance, updates, technical failures, or circumstances beyond our reasonable control (force majeure).
  6. Data Loss: While we take reasonable measures to protect your data, we are not liable for data loss resulting from technical failures, security breaches beyond our reasonable control, or user error.
  7. Financial Losses: Any indirect, incidental, consequential, or punitive damages, including lost profits, arising from or related to the use of the Platform.

Our total liability for any claims arising from the use of the Platform shall not exceed the amount you have paid to Padelatos in the twelve (12) months preceding the claim.

14. Service Availability

  • Availability: We strive to maintain the Platform available 24/7, but do not guarantee uninterrupted access. The Platform is provided on an "as is" and "as available" basis.
  • Maintenance: We may perform scheduled or emergency maintenance that temporarily affects service availability. We will make reasonable efforts to notify users in advance of planned maintenance.
  • Updates: We may update, modify, or discontinue features of the Platform at any time. We will provide reasonable notice for significant changes that affect your use of the service.
  • No Warranty: To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Termination

  • By You: You may close your account at any time by contacting us at hello@padelatos.com. For Clubs with active subscriptions, termination takes effect at the end of the current billing period.
  • By Us: We reserve the right to suspend or terminate accounts that:
    • Repeatedly or seriously violate these Terms of Service
    • Exhibit abusive, threatening, or discriminatory behavior towards other users
    • Engage in fraudulent activity, including rating manipulation or fake bookings
    • Fail to pay subscription fees after a reasonable grace period (for Club accounts)
    • Remain inactive for an extended period (with prior notice)
  • Effect of Termination: Upon termination, your right to access the Platform ceases immediately. Provisions relating to intellectual property, limitation of liability, governing law, and any obligations that by their nature should survive, will remain in effect after termination.
  • Data After Termination: Your data will be handled in accordance with Section 12 (Data Ownership & Portability) and our Privacy Policy.

16. Changes to These Terms

  • We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices.
  • For significant changes, we will notify you via email or through an in-app notification at least 30 days before the changes take effect.
  • The "Last updated" date at the top of this page indicates when these terms were most recently revised.
  • Your continued use of the Platform after changes take effect constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using the Platform and close your account.

17. Governing Law & Dispute Resolution

  • Governing Law: These Terms of Service are governed by and construed in accordance with the laws of Greece, without regard to conflict of law principles.
  • Dispute Resolution: In the event of any dispute arising from or relating to these terms or your use of the Platform, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved amicably within 30 days, it shall be submitted to the competent courts of Athens, Greece.
  • EU Consumer Rights: If you are a consumer resident in the European Union, nothing in these terms affects your statutory rights under applicable EU consumer protection legislation, including the right to use the Online Dispute Resolution platform provided by the European Commission.
  • Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
